Developer city on continued access to the subdivision
A dispute concerning the access road has spawned a new complaint against the city of Billings.
Developer Shane Gundlach, which until 2004 was higher than the Ironwood Estates development in the West End, we brought an action against the city last week. Gundlach tried to sell or develop Tuscany, near Ironwood subdivision, but it can not, because he does not have a secondary access road inside the country, private property.
The complaint alleges that Gundlach has the right to extend Ironwood Drive 60 metres by a free Ironwood much to his property, but that access was removed in a flat final approval by the city. Gundlach’s lawyer, Eric Crist north of the Law Firm, said it’s unclear which deletes the line on the road, but by the approval of flat illegal, the city was involved.
“If (the city) was on tolerance or not, they should have known about this. You have the prisoner,” said North. “Suddenly, the Gundlachs are obliged to something new, they had, and it was just a nightmare for them as far as the management of the city and other interested parties. They are basically on the edge the bankruptcy of this suite. ”
City Attorney Brent Brooks said the city expects its insurance carrier, Montana urban authority insurance, a lawyer is the case. Brooks said that the city is in the fight against the appeal, but did not think the city should be included.
“It is a little fuzzy, all together, why the city was the concentration of (Gundlach) disappointments, if his great dispute with his former partner Ironwood and homeowners club,” he said. “But now, he felt it was appropriate for the city in costume, so that we owe the taxpayers of defending the city as vigorously as possible.”
Gundlach’s problems date back to 2004, when he triggered his relationship with Dan Wells, another developer iron wood. At the end of their agreement, they agreed that Woods might Gundlach Canyon Drive as an access road to his property from the East. Gundlach has also sought to extend Ironwood you go through an open Ironwood, the secondary would have access to its 168.5 hectares, as the city. Gundlach said the first notification of the Ironwood subdivision plat shows facilitation.
Wells did not want Ironwood Drive widened, and access roads was the filing of the second flat. The dispute has been there is an arbitrator who decided that Gundlach was able to buy the vacant lot and that Wells must have access.
But then the Ironwood nonprofit, the Association has been the holder to amend its Covenants for the road. Gundlach claims that the association is the owner of Wells, and he verklagte the association during the summer.
District Judge Susan Watters decided in this case, that Gundlach can not build, because the street Ironwood’s covenants do not allow. Gundlach claims that the decision dish existed for a long time before all the covenants on the ground, and it is well Watters’ decision.
“The city can not really avoid that the first platform (access to the street),” said Gundlach. “The city can not really avoid that the dish is not definitive about it, and they can not not prevent the State law says that you must comply with the provisional findings flat. ”
Gundlach said the law clashes have destroyed his family finances. Excluding the costs of land him more than $ 800 per day, he said, but it can not sell because nobody will buy the country can not be developed. He said once the conflict is resolved, it would sell the country for a developer, because it can no longer develop 49 lots. It is damages and costs of the city. Gundlach said he had been previously announced, nearly $ 5 million for the land.
Gundlach and North said his wife, Stephanie, want to become familiar with the city and all others to resolve the dispute quickly. Among other things, it wants the city, provided access to secondary and modification of the vote Ironwood flat to show the routes of access by former flat.
“We can not once the city to talk to us,” said Gundlach. “They are absolutely not talk to us. We have everything we need to avoid the city complain, but now it is our only option. ”
Brooks said that the city is time for the issue and decide a strategy.
“Given that we are now, where the city has several counts, and it is objectively complex, through work, but we will do our best to ensure a planning objective for the Council to discuss,” said Brooks .
